1. Who we are
This website is operated by Vitapointe International Ltd, a company registered in England and Wales under company number 15053138, with its registered office at 209 Crescent Road, Barnet, England, EN4 8SB.
You can contact us by email at info@vitapointe.co.uk or by telephone on 020 8457 2471, Monday to Friday, 9am to 5pm. If we need to contact you we will do so by email or telephone using the details you gave us when ordering.
VAT registration number: GB476296643.
2. These terms
These terms apply to every order placed through vitapointe.co.uk. By placing an order you confirm that you accept them. Please read them before ordering. We may amend these terms from time to time, and the version that applies to your order is the version published on the date you place it.
You must be at least eighteen years old to place an order. We sell to consumers in the United Kingdom for personal use only. We do not accept orders for resale.
3. Our products
Vitapointe Leave-In Conditioner is a cosmetic product for external use on hair only. Full ingredient information, directions for use and any relevant warnings are shown on the product page and on the product packaging.
The images on our website are for illustration. Although we reproduce colours and packaging accurately, the appearance on your screen may vary slightly from the product itself. Packaging may occasionally differ from the images shown.
4. Placing an order
Your order is an offer to buy from us. After you place an order you will receive an acknowledgement email confirming that we have received it. This does not mean your order has been accepted.
A contract between us comes into existence only when we send you a dispatch confirmation email. If we cannot accept your order, for example because the item is out of stock, because we have identified a pricing error, or because we cannot deliver to your address, we will tell you and will not charge you.
5. Price and payment
All prices are shown in pounds sterling and include VAT where applicable. Delivery costs are shown separately at checkout before you complete your order.
We take payment at the point your order is placed. We accept the payment methods displayed at checkout. Where the price of a product has been stated incorrectly and the error is obvious and could reasonably have been recognised as an error, we are not obliged to supply the product at the incorrect price.
6. Subscriptions
If you choose our subscription option, you authorise us to charge your payment method automatically at the price, frequency and dates shown on the product page, until you cancel. We will email you before each renewal payment is taken.
You can cancel at any time through your account or by emailing info@vitapointe.co.uk. Cancellation takes effect for the next scheduled delivery, provided you tell us at least forty-eight hours before that delivery is due to be processed. Orders already dispatched are subject to our Returns and Refunds policy.
7. Delivery
We deliver to addresses in the United Kingdom only. Delivery options, costs and timescales are set out in our Delivery Information page, which forms part of these terms. We will deliver your order within thirty days of accepting it unless we agree otherwise with you.
Your order becomes your responsibility from the time it is delivered to the address you gave us. You own the goods once we have received payment in full.
8. Your right to cancel and to return
Your right to cancel, our thirty-day returns window and the health and hygiene exemption that applies to opened cosmetic products are set out in our Returns and Refunds policy, which forms part of these terms.
9. Faulty products
We are under a legal duty to supply products that conform to this contract. Under the Consumer Rights Act 2015 goods must be as described, fit for purpose and of satisfactory quality. If we supply a faulty product you may be entitled to a refund, repair or replacement. Nothing in these terms affects those rights.
10. Using the product safely
For external use on hair only. Avoid contact with the eyes, and rinse thoroughly with water if contact occurs. Discontinue use if irritation occurs. Keep out of reach of children. If you have sensitive skin or a known allergy, we recommend carrying out a patch test before first use. Store in a cool, dry place away from direct sunlight.
11. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the products.
We supply products for domestic and private use. We have no liability for any loss of profit, loss of business, business interruption or loss of business opportunity.
12. Events outside our control
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control. If such an event occurs we will contact you as soon as reasonably possible and take steps to minimise the delay. If the delay is substantial you may contact us to cancel and receive a refund for products paid for but not received.
13. Your account and newsletter
If you create an account you are responsible for keeping your login details confidential. You can unsubscribe from our marketing emails at any time using the link in any email, or by contacting us.
14. Intellectual property
All content on this website, including the Vitapointe name, logo, text, images and video, is owned by or licensed to Vitapointe International Ltd. You may not reproduce or use it commercially without our written permission.
15. Complaints
If something has gone wrong, please contact us at info@vitapointe.co.uk. We aim to acknowledge every complaint within two working days and to resolve it within ten working days. If we cannot resolve it in that time we will keep you updated.
16. General
If any part of these terms is found to be unlawful or unenforceable, the remaining provisions continue in force. If we do not insist that you perform any of your obligations, or delay in enforcing our rights, that does not mean we have waived them.
These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in the courts of that country.
